OK. I'm picking up a new/used tank that's already set up. I'm taking the water, at least some and using fresh water. It has cured live rock fish corals etc. My questions is; can I safely add new live sand at the re-setup stage?

I would let the tank sit for a week or so to make sure all is good and if you get fish get hardy fish. I would not use all the water and sand but thats me if you are going to use it all dont use all the water only use 50-75% and add new water for a good water change. Good luck

Yes, it's best to add new sand and not old sand when re setting a tank back up. If you want, keep a cup of the old sand and spread it on the new sand to help establish it.
